Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://hairandskinlab.com website (“the Site”) operated by Hair and Skin Lab (“us”, “we”, or “our”).

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Site.

1. Account Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Site.

You are responsible for safeguarding the password that you use to access the Site and for any activities or actions under your password, whether your password is with our Site or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Products and Services

2.1 Product Information

We strive to provide accurate descriptions, pricing, and availability information for all products on our Site. However, we do not warrant that product descriptions, pricing, or other content is accurate, complete, reliable, current, or error-free. In the event of a pricing error, we reserve the right to refuse or cancel any orders placed for the product at the incorrect price.

2.2 Orders and Payments

When you place an order through our Site, you are offering to purchase a product. We reserve the right to refuse or cancel your order for any reason, including but not limited to: product availability, errors in product or pricing information, or problems identified by our fraud and credit departments.

If your payment has already been processed for an order that is subsequently canceled, we will issue a refund in accordance with our Refund Policy.

2.3 Shipping and Delivery

We will make reasonable efforts to ship products according to the estimated delivery times provided at checkout. However, we cannot guarantee exact delivery dates and times.

Risk of loss and title for items purchased from our Site pass to you upon delivery of the items to the carrier.

3. Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of Hair and Skin Lab and its licensors. The Site is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Hair and Skin Lab.

3.1 User Content

When you upload content to the Site or make content available via the Site (any such material, “User Content”), you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any and all media or distribution methods (now known or later developed).

You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit.

4. Prohibited Uses

You agree not to use the Site:

a) In any way that violates any applicable federal, state, local, or international law or regulation
b) To impersonate or attempt to impersonate our company, an employee, another user, or any other person or entity
c) To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm our company or users of the Site or expose them to liability

Hair and Skin Lab has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Hair and Skin Lab shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

6. Product Policy

6.1 Product Nature

Our products are natural hair and skin care items. Due to the perishable and personal hygiene nature of these products, we generally do not accept returns once products have been opened, as we cannot guarantee their quality or safety for resale.

6.2 Limited Return Policy

We only accept returns for products that arrive damaged or defective in their original, unopened packaging. In such cases, please contact our customer service department within 7 days of receiving your order with photographic evidence of the damage.

For unopened products, returns may be accepted on a case-by-case basis within 14 days of delivery, subject to a restocking fee. Return shipping costs will be the responsibility of the customer unless the return is a result of our error (you received an incorrect item, etc.).

6.3 Allergic Reactions

We carefully list all ingredients in our products. We strongly recommend that customers with known allergies or sensitivities carefully review product ingredients before purchasing. Allergic reactions to correctly described products do not qualify for returns or refunds.

6.4 Refund Process

If a refund is approved, you should expect to receive your refund within four weeks of giving your package to the return shipper. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

7. Disclaimer of Warranties

Your use of the Site is at your sole risk. The Site, its content, and any products or services obtained through the Site are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied.

Hair and Skin Lab expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Hair and Skin Lab does not warrant that a) the Site will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components; or d) the results of using the Site will meet your requirements.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

In no event shall Hair and Skin Lab, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

a) Your access to or use of or inability to access or use the Site;
b) Any conduct or content of any third party on the Site;
c) Any content obtained from the Site; and
d) Unauthorized access, use or alteration of your transmissions or content

Whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify, and hold harmless Hair and Skin Lab, its parent, subsidiaries, affiliates, and all of their respective officers, agents, partners, and employees, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney’s fees and costs, arising out of or in any way connected with:

a) Your access to or use of the Site;
b) Your violation of these Terms;
c) Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or
d) Any claim that your User Content caused damage to a third party.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.

11. Governing Law and International Shipping

11.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

For customers in the European Union, you may also have the right to bring proceedings in your country of residence pursuant to applicable EU consumer protection law.

11.2 International Shipping

We are based in Ireland, Europe, and ship our products globally from our fulfillment centers located in Scandinavia. By placing an order with us, you acknowledge that:

a) Delivery times may vary based on your location
b) Your order may be subject to import duties and taxes levied by the destination country
c) We are not responsible for any customs fees, import taxes, or duties that may be imposed when your order reaches your country
d) Customs policies vary widely from country to country; please contact your local customs office for further information

International customers are responsible for ensuring that the products they order can be lawfully imported to their country. When ordering from us, the recipient is the importer of record and must comply with all laws and regulations of the destination country.

12. Dispute Resolution

12.1 EU Customers

If you are a consumer resident in the European Union, you may have the right to bring proceedings in your country of residence under the EU’s consumer protection regulations. You may also have the right to refer a dispute to the European Commission’s Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/.

12.2 Non-EU Customers

For customers outside the European Union, if we cannot resolve the dispute informally, you and Hair and Skin Lab agree to resolve any disputes through binding arbitration in accordance with the Irish Arbitration Act.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Termination

We may terminate or suspend access to our Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
